The Client : The company or individual requesting the services of Daniel White

Daniel White: The partners, their employees or appointed agents.

Whilst every endeavour will be made to ensure that the website and any scripts or programs are free of errors, Daniel White cannot accept responsibility for any losses incurred due to malfunction, the website or any part of it. 

Daniel White cannot take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material. 

Any additions to the approved visual and brief will be carried out at the discretion of Daniel White and we reserve the right to charge an according amount for any correction to these or further additions agreed with the client prior to making the additions.

The client agrees to make available as soon as is reasonably possible to Daniel White all materials required to complete the site to the agreed standard and within the set deadline. We reserve the right to cancel any project due to unavailability of materials from the client to allow us to complete the site.

The hosting account, domain name, website, graphics and any programming code remain the property of Daniel White until all outstanding accounts are paid in full. Any scripts, cgi applications or software (unless specifically agreed) written by Daniel White remain the copyright of Daniel White and may only be commercially reproduced or resold with the written permission of Daniel White.

Daniel White will not be liable for:

• costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.
• any costs incurred, compensation or loss of earnings due to the work carried out on behalf of the client or any of the clients appointed agents
• any costs incurred, compensation or loss of earnings due to the unavailability of the site, its servers, software or any material provided by its agents.

Daniel White cannot take responsibility for any losses incurred by the use of any software, scripts, applications or databases created for the client. Whilst every care has been taken to ensure products are problem free and accurate, the ultimate responsibility lies with the client in ensuring that all software is functioning correctly before use.

Any scripts, cgi applications or software (unless specifically agreed) written by Daniel White remain the copyright of Daniel White and may only be commercially reproduced or resold with the written permission of Daniel White.

Where applications or sites are developed on servers not set up by Daniel White, the client is expected to provide or seek any information, additional software, support or co-operation pertaining to the server required in order for the application to be correctly developed.

Where large applications are to be developed, it is the clients responsibility to provide a suitable testing environment which is identical to the final production environment.

The client is expected to test fully any application or programming relating to a site developed by Daniel White before being made generally available for use. Where "bugs", errors or other issues are found after the site is live, Daniel White will endeavour (but is not obliged to) to correct these issues to meet the standards of function outlined in the brief.

Daniel White will endeavour to ensure that any developed/designed site or application will function correctly on the server it is initially installed.

Daniel White endeavours to create all projects to be compatible with as many web browsers as possible but cannot guarantee that any custom applications, databases and software will display correctly with all browsers.

Daniel White acts as a reseller for other major companies based in the UK and America which set up suitable hosting packages and register domain names on a dialy basis.

The client is expected to pay the hosting cost and domain name fee's set forth by the hosting company.

Daniel White may with prior agreement with the client pay the hosting company in advance for hosting accounts and domain registrations and as such the client will be expected to repay this charge to us on the final invoice. Should the client cancel our services the client is still responsible for paying the hosting charges and domain fee's if Daniel White has already ordered it at the clients instruction.

The client may cancel their project by a written request. The client will be invoiced for all work undertaken by Daniel White up until the date of cancellation.

If the client has instructed Daniel White to set up a hosting account and/or register a domain name then the client will still be responsible for paying these fees.

Upon completion and the once the client has approved our work, then an invoice will be issued. Payments are to be made immediately upon receipt of this invoice.

Websites will be launched immediately on the clients hosting package. If payment is not received within 7 days the website will be switched offline until outstanding invoices have been paid. It is at the sole discretion of Daniel White whether extra charges are to be issued due to failure of payment within this time period.

Pornographic sites - Pornography is defined by D.White Web Design to be sexually explicit pictures, writing, or other material whose primary purpose is to cause sexual arousal.

Nudity (including photography and art sites) - Women must be wearing a top and bottom (not see through). Men must be wearing clothing on the bottom.

Escort services - Even if your intent is to just have escorts for social occasions. Dating services are allowed as long as they are kept clean.

Adult toy sites - Adult toys are any toys that are designed to be used in a sexual act.

Sale of adult materials - such as magazines, and just about any other adult item.

An exception is lingerie sites but these cannot show nudity or sell adult toys.

If you have see through lingerie on your site then you must edit the pictures so that nudity is not shown.

Yes. If someone wants to advertise on your site, that's fine. If you want to link to their site and them to you, that's fine. All we ask is that you contact us first before you commit yourself, as there are some advertisements we do not allow.
